AN ORDINANCE CALLING AN ELECTION TO BE HELD FOR THE PURPOSE OF SUBMITTING TO THE QUALIFIED ELECTORS OF BANNOCK COUNTY, IDAHO, THE PROPOSITION OF THE ISSUANCE OF UP TO $16,000,000 NEGOTIABLE BONDS OF BANNOCK COUNTY, IDAHO, AND IN PROVIDING FOR THE ISSUANCE OF SUCH BONDS, THE LEVY OF A TAX TO PAY SUCH BONDS.
the acquisition, construction and equipping of an addition and related remodeling and improvements to the existing Bannock County jail facilities, and the acquisition, construction and equipping of a facility for the provision of crisis care, stabilization and alternatives to incarceration, including behavioral, substance abuse and mental health services (collectively, the “Project”), are deemed by the Board of County Commissioners of Bannock County, Idaho (the “County”) to be required for the public good and welfare of the County; and
the County does not have sufficient funds available to pay the cost of the Project and has determined it advisable to finance such cost through the issuance of the bonds of the County pursuant to the provisions of chapter 19, Title 31, Idaho Code, and in order to do so desires to call an election to be held pursuant to chapter 14, Title 34, Idaho Code, for electorate authorization of issuing bonds to finance the Project;
the Clerk of Bannock County, Idaho (the “County Clerk”), has verified the total existing indebtedness, including interest accrued, of the County is as set forth in the forms of ballot and notice hereinafter provided.
THEREFORE, BE IT ORDAINED
by the Board of County Commissioners of Bannock County, Idaho (the “Board”), as follows:
That a General Obligation Bond Election (the “Bond Election”) is hereby called to be held in Bannock County, Idaho, on Tuesday, November 7, 2017, for the purpose of submitting to the qualified electors of the County the proposition set forth in the form of ballot hereinafter provided.
That pursuant to Section 34-1401, Idaho Code, the County Clerk shall administer the Bond Election, including scheduling the polling times; preparing and printing the ballots; publishing the notice of the Bond Election and the sample ballot; and conducting the Bond Election.
For purposes of the Bond Election, the Board hereby approves the form of ballot as set forth below:

NOTICE OF GENERAL OBLIGATION BOND ELECTION
Pursuant to the laws of the State of Idaho and the Bond Election Ordinance No. 2017-8 of the Board of County Commissioners of Bannock County, Idaho, adopted on September 18, 2017, notice is hereby given that a General Obligation Bond Election will be held in the County on Tuesday, November 7, 2017, beginning at the hour of 8:00 A.M. and closing at the hour of 8:00 P.M. on said date, for the purpose of taking a vote on the question of whether the County shall be authorized to issue and sell general obligation bonds to finance (i) the acquisition, construction and equipping of an addition and related remodeling and improvements to the existing Bannock County jail facilities, and (ii) the acquisition, construction and equipping of a facility for the provision of crisis care, stabilization and alternatives to incarceration, including behavioral, substance abuse, and mental health services, and to pay expenses related thereto and costs of issuance of the bonds.
The bonds shall be due in installments as fixed by the Board of Commissioners of the County, the last installment to be due and payable not more than twenty (20) years from the date of the bonds.
The project to be financed by the sale of the proposed bonds is set forth above. The date of the bond election is November 7, 2017. The principal of the bonds to be issued is up to $16,000,000.00. The anticipated interest rate on the proposed bonds, based upon current market rates, is two and ninety-eight hundredths percent (2.98%) per annum.
The total amount to be repaid not later than twenty (20) years from the date of such bonds, based on the anticipated interest rate, is $21,668,225.00, consisting of $16,000,000.00 in principal and $5,668,225.00 of interest.
As of November 7, 2017, the total existing bonded indebtedness of the County, including interest accrued, is $0.00.
Early Voting, Absentee Voting and Polling Sites
Early Walk-In Voting
The Bannock County Elections Office will be open for Early-Walk In Voting beginning on October 9, 2017. The hours will be 9:00 am to 4:30 pm, Monday through Friday. Pursuant to Idaho Code §34-1012, the last day to Early Vote will be Friday, November 3, 2017.
Pre-Register to Vote
The last day to pre-register to vote for the November 7, 2017, Election is October 13, 2017. Idaho does allow same day voter registrations.
Pursuant to Idaho Code §34-1002, October 27, 2017, is the last day for an application for a mail-in absentee ballot to be received by the County Clerk no later than 5:00 pm for the November 7, 2017, Election. Absentee applications can be requested by calling 208-236-7333 or downloaded from www.bannockcounty.us/elections/

That if at the Bond Election two-thirds (2/3) of the qualified registered electors of the County, eighteen (18) years of age or older who have resided in the County for thirty (30) days, voting thereat assent to the issuance of said bonds, as certified by the County Clerk, the negotiable bonds of the County shall be issued as hereinabove provided and shall mature not more than twenty (20) years from their date and the annual bond maturities thereof shall be payable in accordance with the provisions of the Municipal Bond Law of the State of Idaho. Such issue will create a new debt for the object of providing for the acquisition and construction of the Project, and to pay costs of issuance of such bonds, in accordance with the provisions of § 31-1903, Idaho Code, payable from the proceeds of ad valorem taxes.
That said negotiable bonds shall be issued if carried as aforesaid and payment shall be made from available sources of revenue, if any, and through the levy of taxes on all taxable property in Bannock County, Idaho, beginning in the year principal and interest payments are due and continuing until principal and interest shall have been fully paid in such amounts and at such rates as are necessary to assure the prompt payment of such interest, and also to establish and to constitute a sinking fund sufficient for the payment of the principal thereof as required by law, and it is hereby ordered that such taxes shall be levied annually at the time and in the manner as general taxes for said County are levied in each such year; provided, however, the aforementioned taxes shall never be diminished prior to payment of all bonds excepting in any year to the extent that other available funds shall have been applied to or set aside in a special fund to be irrevocably held for the payment of principal or interest or both, payable from said taxes for such year. The proper officer or officers of said County are hereby authorized and directed to do all things requisite and necessary to carry out the provisions of this section and to apply the proceeds of the taxes so collected to the payment of such principal and interest.
